Terms & Conditions

Please read these Terms carefully before creating an account or making a purchase. By using Purehire, you agree to be bound by these Terms in their entirety. Operated by Febin and Dale Ventures Private Limited.

§1

Parties and Acceptance

These Terms & Conditions ("Terms") constitute a legally binding contract under the Indian Contract Act 1872 between Febin and Dale Ventures Private Limited ("Purehire", "we", "us") and the Recruiter or Employer creating an account or making a purchase ("you" or "Recruiter").

Acceptance of these Terms occurs at the earliest of: (a) creating an account on the platform; (b) making a payment for any Purehire service; or (c) posting a job. There is no option to partially accept these Terms. Use of any feature of the platform constitutes acceptance of all Terms in their entirety.

If you are acting on behalf of a company, you represent and warrant that you have the legal authority to bind that company to these Terms. If you do not have such authority, you must not use the platform on the company's behalf.

Purehire's services are available exclusively to businesses and individuals acting in a commercial capacity for recruitment purposes. Purehire is not a consumer-facing service for job-seekers. Job-seekers (candidates) are governed by separate terms applicable at the point of application.

Effective Date: April 3, 2026. These Terms apply to all accounts created on or after this date, and to existing accounts on renewal of any paid service.
§2

Definitions

The following terms have precise meanings throughout this document. Do not substitute informal equivalents.

Job PostA single listing for one vacancy, purchased at the stated price, valid for 30 calendar days from activation.
Resume SlotThe unit representing one candidate application received against a Job Post. Each standard Job Post includes 250 Resume Slots.
AI Match ScoreAn automated relevance score generated by Purehire's AI pipeline (Google Gemini and/or Groq AI) for a candidate's resume against a specific Job Post.
PlatformThe Purehire web application accessible at purehire.in and any associated subdomains.
Business DaysMonday through Friday, excluding Indian public holidays.
Material ChangeAny change to pricing, refund policy, data rights, liability caps, or termination conditions.
Data FiduciaryAs defined under DPDPA 2023 — an entity that determines the purpose and means of processing personal data.
§3

Service Description

What Purehire Provides

  • A platform for Recruiters to create, publish, and manage job postings
  • Automated distribution of job listings to job-seeking candidates
  • Collection and delivery of candidate applications (resume and contact details) up to the purchased Resume Slot limit
  • AI-generated Match Scores for each application against the job's stated requirements
  • Basic applicant tracking within the platform dashboard

What Purehire Does Not Provide

  • Any guarantee of a minimum number of applications for any Job Post
  • Any guarantee of candidate quality, truthfulness of resumes, or suitability for the role
  • Background verification, reference checks, or credential validation
  • Any employment placement guarantee
  • Legal advice on job posting compliance
  • Any ongoing relationship after a Job Post expires and is not renewed

Nature of AI Scoring — Advisory Only

AI Match Scores are generated by large language models and are advisory outputs only. They are not hiring decisions, not assessments of a candidate's character, and not legally defensible grounds for rejection in isolation.

Purehire does not warrant the accuracy, completeness, or fitness of AI Match Scores for any particular purpose. Model outputs may contain errors, biases, or omissions.

Sole reliance on AI Match Scores to hire or reject a candidate is prohibited and is the Recruiter's legal risk. Recruiters must apply independent human judgement to all hiring decisions. Purehire accepts no liability for outcomes resulting from exclusive reliance on AI-generated scores.
Using AI scores as the sole or primary basis for a hiring decision may constitute unlawful discrimination under Indian employment law if the model's output reflects or amplifies protected-ground biases. Recruiters bear full responsibility for their hiring process.
§4

Recruiter Eligibility and Registration

  • Recruiters must be 18 years of age or older.
  • Recruiters must be legally authorised to hire employees or engage contractors in India.
  • Recruiters must provide accurate registration information. Material misrepresentation — including a false company name, non-existent entity, or fictitious role — is grounds for immediate account termination without refund (Level 3, Section 11).
  • Recruiters are responsible for maintaining the security of their account credentials. Purehire is not liable for unauthorised access caused by a Recruiter's own credential compromise.
  • One account per legal entity. Creating multiple accounts for the same legal entity to circumvent platform limits is prohibited.
Accounts registered with false or unverifiable company information may be suspended pending verification without notice, and permanently terminated if the misrepresentation is confirmed.
§5

Recruiter Obligations

5.1 Legal Compliance

Recruiters bear sole and complete responsibility for compliance with all applicable Indian laws in their job postings and hiring practices, including:

Purehire's review or approval of a job posting does not constitute legal validation of that posting. Purehire is not a legal compliance service.

5.2 Prohibited Content in Job Postings

Job postings must not contain:

  • Discrimination based on any of the following grounds (protected under Articles 15 and 16 of the Constitution of India and applicable employment law): Caste, Gender, Religion, Age, Race, Disability, Sexual orientation, Marital status, Pregnancy or maternity status, Language, Region of origin
  • False or misleading information about the role, salary, company, or working conditions
  • Requirements that are illegal under Indian employment law (e.g. waiving statutory entitlements)
  • Content that facilitates or implies sexual harassment
  • Requirements for payment from candidates (fee-based job scams)
  • Roles that involve illegal activity under any Indian law
  • Vague or non-specific roles designed to harvest candidate data without genuine hiring intent

5.3 Conduct Obligations

  • No automated scraping, bots, or programmatic platform access without written authorisation
  • No multiple accounts or circumvention of platform limits
  • No fraudulent payment methods
  • No misrepresentation of company identity, size, or role details
  • No spamming candidates through contact information obtained via Purehire
  • No harassment or abusive communication directed at candidates

5.4 Candidate Data Obligations (Post-Download)

Upon downloading or accessing candidate data, the Recruiter becomes an independent Data Fiduciary under DPDPA 2023 for that data and assumes independent legal responsibility for its processing.

Permitted use:

  • Evaluation and communication solely for the specific role the candidate applied to

Prohibited uses:

  • Sharing or selling candidate data to any third party
  • Using candidate data for any purpose other than evaluating the specific application
  • Contacting candidates for roles other than the one applied to, without the candidate's fresh consent
  • Storing candidate data beyond the Recruiter's own legitimate retention period for hiring records
  • Using candidate data to build marketing lists or contact databases

Recruiters must maintain their own data security measures for downloaded candidate data. Purehire is not liable for candidate data misuse that occurs after download from the platform.

§6

Intellectual Property

6.1 Recruiter Owns Job Descriptions

Job descriptions authored by the Recruiter remain the sole intellectual property of the Recruiter. Purehire acquires only a limited, non-exclusive licence to display and distribute the job posting on the platform for the duration of the Job Post.

6.2 Candidate Data — No Ownership by Purehire

Candidate personal data (resumes, contact details, application content) is owned by the candidate as the Data Principal under DPDPA 2023. Purehire holds and processes this data as Data Fiduciary under a licence granted by the candidate's consent at the point of application. Purehire does not claim ownership of candidate personal data.

6.3 AI Match Scores

AI Match Scores are generated outputs of Purehire's platform. They are derived works created by Purehire's AI pipeline and are proprietary to Purehire. Recruiters receive a limited, non-transferable licence to use AI Match Scores solely for evaluating candidates for the specific role to which those scores relate.

6.4 Platform and Technology

All platform code, algorithms, UI designs, trademarks, and the Purehire brand are the exclusive intellectual property of Febin and Dale Ventures Private Limited. No licence to these is granted to Recruiters beyond the right to use the platform as described in these Terms.

6.5 Anonymised Aggregated Data Licence

By using Purehire, Recruiters grant Purehire a perpetual, royalty-free licence to use anonymised and aggregated data derived from platform usage — including job category trends, salary range distributions, and application volume patterns — to:

  • Improve the Purehire platform and AI models
  • Generate industry analytics and benchmarks
  • Train or refine AI scoring models
This licence explicitly excludes:
  • Individual job descriptions attributable to a specific Recruiter or company
  • Any data that could identify the Recruiter, their company, their candidates, or specific roles
  • Salary data attributable to a specific company or posting
  • Any use of Recruiter data for advertising or sale to third parties
Only truly anonymised and aggregated data — from which no individual or company can be identified — is used under this licence. This is consistent with and does not override the Purehire Privacy Policy.
§7

Payment Terms

7.1 Pricing (as of Effective Date)

  • Prices are displayed inclusive of applicable taxes at checkout.
  • Purehire reserves the right to change pricing with 30 days' advance email notice to registered Recruiters.
  • Price changes do not apply retroactively to Job Posts already purchased.

7.2 Payment Processing

  • All payments are processed by Razorpay. Purehire does not store card numbers, UPI credentials, or banking details.
  • Accepted payment methods are those listed on Razorpay's checkout at the time of payment.
  • A Job Post is activated only upon successful payment confirmation. Failed payments result in no Job Post being created.

7.3 GST and Invoicing

  • Applicable GST will be computed and displayed at checkout.
  • A tax invoice will be issued to the email address on the Recruiter's account within 2 business days of payment.
  • Recruiters must provide accurate GST registration details (if applicable) at account setup. Purehire is not liable for incorrect invoices resulting from inaccurate information provided by the Recruiter.
If you require a revised invoice due to an error in your GST details, contact support@febinanddale.com within 5 business days of the invoice date.
§8

Job Post Duration and Resume Slots

8.1 Job Post Validity

  • Each Job Post is valid for 30 calendar days from the date and time of activation.
  • At expiry, the Job Post is automatically deactivated. No further applications will be accepted.
  • Expired Job Posts cannot be reactivated. A new purchase is required for continued listing.

8.2 Resume Slot Limits

  • Each Job Post includes 250 Resume Slots as standard.
  • Once 250 applications are received, the job listing is automatically closed to further applications.
  • Unused slots at expiry are forfeited and have no monetary value.
  • Slots are non-transferable between Job Posts.

8.3 Additional Resume Slots (Top-Up)

  • Additional slots may be purchased in blocks of 100 at ₹30 per block while the Job Post is active.
  • Top-ups may be purchased at any time while the Job Post is active, except within 6 hours of the Job Post's scheduled expiry time.
  • Top-up slots purchased for one Job Post cannot be transferred to another.
  • Top-up slots expire with the Job Post and are forfeited with no refund if the Job Post expires before they are used.
The 6-hour cutoff before expiry is a hard system restriction. No exceptions, extensions, or manual overrides are available under any circumstances.
Slots are non-transferable and have no monetary value after expiry. No refund is available for unused top-up slots at any point.
§9

Refund Policy

9.1 General Rule

All purchases of Job Posts and Resume Slot top-ups are non-refundable once the Job Post is activated (i.e. live on the platform).

9.2 Exception — Platform Error

A refund or remediation is available only if all three of the following conditions are met:

  1. The Job Post was paid for but failed to go live due to a documented platform error on Purehire's side — not a payment failure, browser issue, or Recruiter error.
  2. The Recruiter reports the issue to support@febinanddale.com within 7 calendar days of the failed posting.
  3. Purehire's support team is unable to resolve the posting error and make the Job Post live within 5 business days of the report.
If all three conditions are met, the Recruiter is entitled to either: (a) a full refund of the amount paid for that specific Job Post, or (b) a credit for a future Job Post of equivalent value — at the Recruiter's choice.

9.3 What Is Not Refundable

  • Job Posts that go live but receive fewer applications than expected
  • Job Posts cancelled by the Recruiter after going live
  • Job Posts removed by Purehire due to Terms violations
  • Unused Resume Slots (partial or full) at Job Post expiry
  • Top-up slot purchases at any point after purchase
  • Payments where the Recruiter provided incorrect job details and wishes to repost

9.4 Refund Process

  • All refund requests must be submitted to support@febinanddale.com with subject line: [REFUND REQUEST] Job Post ID: <id>
  • Purehire will respond within 7 business days of receipt.
  • Approved refunds will be processed to the original payment method within 10 business days of approval.
§10

Limitation of Liability

10.1 Liability Cap

Purehire's total aggregate liability to a Recruiter for any claim arising under these Terms is limited to the amount paid by that Recruiter for the specific Job Post to which the claim relates.

This cap applies regardless of the legal theory of the claim — contract, tort, negligence, or otherwise.

10.2 Excluded Damages

Purehire is not liable under any circumstances for:

  • Lost profits or lost business revenue
  • Missed hiring deadlines or consequential staffing costs
  • Reputational harm
  • Loss of data caused by the Recruiter's own systems
  • Actions or omissions of candidates
  • Third-party service failures (Razorpay, Google Gemini, Groq AI) that are outside Purehire's reasonable control

10.3 What Purehire Is Not Responsible For

  • The accuracy, completeness, or truthfulness of resumes submitted by candidates
  • Candidate conduct before, during, or after the hiring process
  • Recruiter's own compliance with employment law
  • Disputes between Recruiters and candidates
  • Outcomes of hiring decisions, including candidate performance or no-shows

10.4 No Warranty

The platform is provided "as is." Purehire makes no warranty — express, implied, or statutory — regarding: uninterrupted or error-free service; a minimum number of applications for any Job Post; the fitness of AI Match Scores for any specific hiring decision; or the accuracy of AI-generated outputs.

10.5 Consumer Protection Act 2019

Nothing in this Section limits a Recruiter's statutory rights under the Consumer Protection Act 2019 where the Recruiter qualifies as a "consumer" as defined under that Act. Individual recruiters (sole proprietors) who purchase services for purposes not exclusively commercial may have additional statutory protections. Such Recruiters may raise grievances through the Purehire grievance mechanism (Section 14) or the National Consumer Disputes Redressal Commission as applicable.
§11

Account Suspension and Termination

Purehire applies a proportionate response to Terms violations. The level of response is determined by the nature and severity of the violation.

Level 1 — Written Warning

Triggered by: First instance of a non-fraudulent, non-harmful violation (e.g. incomplete job description, minor inaccuracy in a posting).

  • Purehire will notify the Recruiter by email specifying the violation and required corrective action.
  • The Recruiter has 5 business days to remedy the issue.
  • No service disruption occurs at this level.

Level 2 — Temporary Suspension (7–30 days)

Triggered by: Repeated Level 1 violations after warning; unresolved non-critical violations; multiple unverified candidate complaints.

  • Access to the platform is suspended pending investigation.
  • Active Job Posts remain live during suspension unless the violation relates to a specific posting.
  • Recruiter is notified by email with the reason and duration of suspension.
  • Recruiter may appeal within 5 business days of the suspension notice (see Section 11.2).

Level 3 — Permanent Termination (Zero-Tolerance)

Triggered immediately, without warning, by any of:

  • Fraudulent payment or payment chargebacks used as a pattern
  • Posting jobs that are illegal under Indian law — scam roles, roles requiring payment from candidates, etc.
  • Harassment or abuse of candidates
  • Unauthorised automated access, scraping, or denial-of-service attempts
  • Misuse of candidate data — sale, redistribution, or use beyond permitted purposes
  • Multiple verified complaints of discriminatory hiring practices
  • Providing materially false registration information

Consequences of permanent termination:

  • Immediate loss of all platform access
  • Active Job Posts deactivated immediately
  • No refund of any payments made
  • Data handling per the Purehire Privacy Policy
  • Purehire reserves the right to pursue civil or criminal legal action for violations involving fraud, data misuse, or harm to candidates

11.2 Appeal Process

  • Level 2 suspensions may be appealed by emailing support@febinanddale.com within 5 business days of the suspension notice.
  • Purehire will review and respond within 7 business days.
  • The suspension remains in effect during the appeal review period.
  • Purehire's decision on appeal is final for Level 2 violations.
Level 3 terminations are not subject to internal appeal but may be challenged through the formal dispute resolution process described in Section 14.
§12

Force Majeure

Purehire is not liable for failure or delay in providing services due to events outside its reasonable control, including: natural disasters, acts of government, internet infrastructure failures, actions by cloud or hosting providers, CERT-In orders, pandemics, or civil unrest.

  • Purehire will notify affected Recruiters within 5 business days of a force majeure event affecting their Job Posts.
  • If a force majeure event prevents service delivery for more than 30 consecutive calendar days, the affected Recruiter may request either:
    • A full refund of amounts paid for affected Job Posts, or
    • A free extension of the Job Post duration equal to the disruption period
Force majeure does not excuse Purehire's obligation to protect candidate data. Data security measures remain in effect regardless of service availability.
§13

Modifications to These Terms

13.1 Material Changes

Material changes — to pricing, refund policy, data rights, liability caps, or termination conditions — require:

  • 30 days' advance notice via email to the Recruiter's registered email address.
  • Active re-acceptance: Recruiters must affirmatively accept the new Terms before their next purchase or login after the change takes effect.
Continued use of the platform after the effective date of a Material Change, without affirmative re-acceptance, is not valid acceptance of that change. If you do not accept a Material Change, you may discontinue use and request a refund for any unused, active Job Posts under the force majeure refund pathway (Section 12), applied by analogy.

13.2 Non-Material Changes

Non-material changes — formatting, contact details, clarifications that do not alter rights or obligations — take effect upon publication, with notification via the platform or email.

13.3 Archived Versions

Previous versions of these Terms are available upon request to support@febinanddale.com. The effective date of the current version is displayed at the top of this document.

§14

Dispute Resolution

14.1 Informal Resolution First

Before initiating formal proceedings, the Recruiter must:

  1. Submit a detailed grievance to support@febinanddale.com with the subject line: [DISPUTE] <brief description>
  2. Allow Purehire 7 business days to respond with a proposed resolution.
  3. Engage in good-faith discussion for a further 14 calendar days.

14.2 Formal Proceedings

  • If informal resolution fails, disputes are subject to the exclusive jurisdiction of courts in Kozhikode, Kerala, India.
  • Governing law: the laws of the Republic of India.
  • Nothing prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction without first completing the informal process.

14.3 Consumer Disputes

Individual Recruiters who qualify as consumers under the Consumer Protection Act 2019 may approach the appropriate Consumer Disputes Redressal Forum without first exhausting the informal resolution process described in Section 14.1.
§15

Indemnification

The Recruiter agrees to indemnify, defend, and hold harmless Febin and Dale Ventures Private Limited, its directors, officers, and employees against any claim, demand, loss, liability, or legal cost (including reasonable advocate fees) arising from:

  • The Recruiter's job postings, including claims of discrimination, misrepresentation, or illegal content
  • The Recruiter's interactions with candidates
  • The Recruiter's violation of applicable Indian employment or data protection law
  • The Recruiter's breach of these Terms
  • Any claim by a candidate arising from the Recruiter's misuse of candidate data after download from the platform
This indemnification obligation survives the termination of the Recruiter's account, regardless of the reason for termination.
§16

Severability

If any provision of these Terms is found invalid, unenforceable, or contrary to law by a competent court, that provision is severed to the minimum extent necessary, and the remaining Terms continue in full force and effect. The parties agree that the severed provision should be reformed to best reflect the original intent within legal bounds.

§17

Entire Agreement

These Terms, together with the Purehire Privacy Policy, constitute the entire agreement between the Recruiter and Febin and Dale Ventures Private Limited with respect to use of the platform. They supersede all prior agreements, representations, and understandings, whether written or oral, relating to the same subject matter.
